Child Support
Child Support is intended to maintain the same living standard for the children of a marriage that they enjoyed before their parents separated or divorced. Even if the parents were never married or living together the court may order one or both parents to make payments for support and expenses. The parents are expected to share the expenses of raising dependent children regardless of where they reside. The amount of child support a parent will pay is determined by the guideline established by the California State Legislature.
Child Support Payment Calculation
California child support guidelines are based on a number of factors that take into consideration how much time a child spends with each parent and their income. Income considered for these purposes include:
- Wages from employment including tips, commissions, and bonuses.
- Self-employment income including profits from a business.
- Unemployment benefits.
- Disability and workers' compensation.
- Investment income including interest, dividends and rental income.
- Social Security and pension benefits.
- Any extra ordinary income such as lottery or prize winnings.
Certain items can be deducted from income calculations such as:
- Tax payments.
- Mandatory union dues.
- Health insurance premiums.
- Child and spousal support payments.
- Costs of raising other dependent children.
Custody often affects child support obligations. If one parent has sole custody the other parent typically pays child support to the custodial parent. In a joint custody each parents obligation is based on their earnings and the amount of time each spends with a child.
Once issued, a child support order can only be changed if there is a “material change of circumstances.” There are no stipulations for what actually constitutes a material change but could be anything that would pertain to any element within the guidelines such as income or expenses.
